AR3S Terms of Use

This website is made available as a service to our customers. Please review the following basic rules that govern your use of our website (the “Agreement”). Please note that your use of our website constitutes your unconditional agreement to be bound by and follow these Terms and Conditions.

Although you may “bookmark” a portion of this website and thereby bypass this Agreement, your use of this site still binds you to the terms. ar3s.ai reserves the right to update or modify these Terms and Conditions at any time without notice. Your use of this www.ar3s.ai website following such change constitutes your unconditional agreement to be bound by and follow the Terms and Conditions as they change. For this reason, we encourage you to review these Terms and Conditions whenever you use this website.

Dispute Resolution and Arbitration Agreement

Any dispute or claim arising out of or relating in any way to these terms, your visit to the site, or to any purchase, transaction, return or other interaction with company (including claims relating to company’s advertisements and disclosures, email and mobile sms messages sent by company, or company’s collection or use of your information) (“dispute”) shall be resolved through binding arbitration, rather than in court. The federal arbitration act and federal arbitration law apply to this agreement.

Any party who intends to seek arbitration must first try in good faith to resolve the dispute by providing to the other party a written notice (“notice”) describing the facts and circumstances of the dispute and the specific relief sought, and including any supporting documentation. The notice must be mailed via certified or registered mail to:

AR3S LLC

16192 Coastal Hwy

Lewes, DE 19958

Attn: General Counsel

Or to you at your last-used billing address or the billing and/or shipping address in your online profile. If we are unable to reach an agreement to resolve the claim within thirty (30) days after the notice is received, either party may commence arbitration.

Any arbitration under this agreement shall be conducted by the American Arbitration Association (’AAA’), adr.org, 1.800.778.7879, and pursuant to the then applicable AAA commercial arbitration rules and mediation procedures. You may choose to have the arbitration conducted by telephone, based on written submissions, in person in the county where you live, or at another mutually agreed location. Unless the arbitrator finds some or all of your claims to be frivolous, without merit or otherwise non-reimburseable, company will reimburse your reasonable attorney’s fees and costs for claims totaling less than $10,000 and agrees not to seek attorneys’ fees or costs from you. In lieu of arbitration, either you or company may assert individual claims in small claims court consistent with the jurisdictional and dollar limits that may apply. This section will survive after the terms of use terminate or your use of the site ends.

If you have in any manner violated or threatened to violate any company intellectual property right, we may bring suit in any state or federal court in the commonwealth of puerto rico. You consent to exclusive jurisdiction and venue in these courts.

Class Action Waiver

You and Company agree that any Dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, collective, or representative action. If this class action waiver is found to be void or unenforceable, the Dispute shall be resolved in state or federal court rather than in arbitration. You further agree that you will not be a member of any putative or actual class in a class action brought by anyone else, nor will you seek to become a class representative. You further agree that in any action you initiate, any relief you seek will be confined to relief on your own behalf. This section will survive after the Terms of Use terminate or your use of the Site ends.

Governing Law

By visiting this Site, you agree that the Federal Arbitration Act, applicable federal law, and the laws of the Commonwealth of Puerto Rico without giving effect to any conflict of law provisions, shall govern any proceeding that occurs in arbitration. In the event any claim is found not to be arbitrable, normal choice-of-law rules shall apply to any proceeding brought in state or federal court.

  1. Refund & Shipping Policy

Delivery & Shipping Overview

We will arrange for the shipment of the products to you. Please check the individual product page for specific delivery options. You will pay all shipping and handling charges specified during the ordering process unless explicitly stated by a valid promotion and the particular terms and conditions of AR3S.

  • Processing Times: We are closed on weekends and major US & PR holidays. All orders received on Friday after 12 noon, Saturday, and Sunday will begin processing the following business day. Please allow three (3) to seven (7) business days for these orders to be processed as estimated times could vary due to high order volume.
  • Risk of Loss: Title and risk of loss pass to you upon our transfer of the products to the carrier/delivery. Shipping and delivery dates are estimates only and cannot be guaranteed. We are not liable for any delays in shipments.

Return & Exchange Policy

We want you to be completely satisfied with your purchase. Please review this policy carefully before buying. This policy is prominently displayed at checkout, on receipts, our website, and in-store signage (in English and Spanish) to ensure full transparency, in compliance with Synchrony Bank requirements for fair and reasonable terms and Puerto Rico's Department of Consumer Affairs (DACO) regulations on disclosure and consumer protection.

Return Window

  • Most consumer electronics, computers, laptops, tablets, monitors, accessories, and related items may be returned or exchanged within 14 calendar days from the date of purchase (or delivery for online/phone orders).
  • The 14-day period applies to both opened and unopened items unless otherwise noted.

Eligibility Requirements

  • Items must be in resalable condition — original packaging (if applicable), all accessories, manuals, cables, software, registration cards, and any included items must be returned intact and undamaged.
  • Proof of purchase (receipt, order confirmation, or packing slip) is required. No additional personal information is needed beyond this for standard returns.
  • For online purchases, items must be shipped back (or returned in-store) with tracking if requested; return shipping costs may apply unless the item is defective.

Special Categories & Restrictions

  • Activatable/mobile devices (e.g., cell phones, smartwatches with cellular, prepaid phones): Strict 14-day return window; must be unactivated or in like-new condition with original seals if applicable.
  • Software, digital downloads, gift cards, and opened consumables (e.g., printer ink, batteries): Non-returnable/non-exchangeable unless defective.
  • Custom-built or special-order computers: May be subject to restocking fees or non-returnable if personalized.
  • Defective/damaged items: Covered under manufacturer warranty; returns accepted beyond 14 days if within the warranty period. We handle initial returns for defects within 14 days as a courtesy.

Restocking Fees

  • Original shipping fees are non-refundable unless the return is due to our error or a defective product.
  • Store credit does not expire and can be used toward any eligible merchandise.

How to Initiate a Return
